# How to fill in the constat amiable

The accident report form decides who pays, and most mistakes are made in the minutes after the crash. Here is each part of the form, in the order you fill it in.

- **When:** A collision between vehicles, with damage only
- **How many forms:** One for both drivers. Each keeps a copy
- **Deadline:** Hand it to your insurer within 5 days
- **Someone is hurt:** Call the police: 19 in town, 177 outside towns

## Before you start

1. **Make the scene safe.** Hazard lights on, warning triangle out, everyone off the road.
2. **If someone is injured,** call the police on 19 in town (190 from a mobile) or the Gendarmerie royale on 177 outside towns, and an ambulance on 15 (150 from a mobile). Leave the vehicles where they are unless they put others in danger: the officers draw up an official report.
3. **Photograph before anything moves:** both cars, the plates, the road, the signs and the other driver's insurance certificate.
4. **Take out the form.** Keep a blank one in the glovebox; your insurer or agent supplies it. An electronic version is being introduced: ask your insurer whether its app offers it. The paper form stays valid.

## The form, part by part

**The constat amiable: where each part is**

*A simplified drawing of the form. The numbers match the steps below, not the numbers printed on the form. Vehicle A is on the left, vehicle B on the right.*

1. **Date, time and place.** The exact address or the road and the nearest town.
2. **Injuries and other damage.** Tick whether anyone was hurt, even slightly, and whether anything other than the two cars was damaged: a wall, a pole, a parked car.
3. **Witnesses.** Names and phone numbers. A witness who was in neither car carries the most weight.
4. **Policyholder and vehicle.** Each driver fills in their own column: owner's name and address, make, model and plate.
5. **Insurer and certificate.** Copy the company, the certificate number, its validity dates and the agency from the insurance certificate. Check the other driver's certificate yourself.
6. **Driver.** The person driving, who may not be the owner: name, address and driving licence.
7. **Point of first impact.** Mark with an arrow where your car was first hit.
8. **Visible damage.** Describe what you see, without guessing hidden damage.
9. **Circumstances.** Tick, in your column only, the boxes that describe what your car was doing: parked, starting, turning, overtaking, changing lane. Insurers decide liability from these boxes and the sketch. If the form asks for the number of boxes ticked, write it: no one can add a box later.
10. **Observations.** Anything the boxes do not say. If you disagree with the other driver, write it here. Never leave it blank in a dispute.
11. **Sketch.** The road and its lanes, the direction of each car with an arrow, their positions at the moment of impact, the signs and the street names.
12. **Signatures.** Both drivers sign, and each keeps a copy. Nothing may be changed after signing. Signing records the facts; it does not admit fault.

## Mistakes that cost money

- Signing a form that is half empty, or that the other driver will "finish later".

- Writing "it is my fault" or "I did not see him". Describe the facts; insurers decide liability.

- Ticking boxes in the other driver's column, or leaving the box count empty.

- Leaving without the other driver's certificate number and insurer.

- Forgetting the witnesses' phone numbers.

- Repairing the car before your insurer's adjuster has seen it.

## If the other driver refuses or drives away

- **Refuses to sign.** Fill in your side, write the refusal in the observations, note the plate, the make and the colour, photograph everything and take the witnesses' details. Call the police so that an official report is made.

- **Drives away, or has no insurance.** For injuries, the Fonds de Garantie des Accidents de la Circulation (FGAC) compensates victims when the person at fault is unknown, or uninsured and unable to pay. For damage to your car you depend on your own guarantees: all-risks pays in every case, while collision damage needs an identified third party.

## Within 5 days

1. Hand the form to your own insurer, or send it by registered letter, within 5 days, and note the claim number.
2. The insurer appoints an adjuster. Wait for the visit before any repair.
3. Under the direct compensation convention between insurers (CID), your own insurer pays for your damage according to your share of liability, and recovers the money from the other insurer. You deal with one company only.
4. If you were at fault, your insurer pays the other driver and your next premium carries a surcharge: see [the CRM](https://dashboard.cr43dv6zq7.com/morocco-insurance-guide/en/car-insurance/#reduction-and-surcharge-the-crm).

## Questions

**Does signing the constat mean I admit fault?**

No. Signing records the facts that both drivers accept. Liability is decided by the insurers from the boxes ticked and the sketch.

**Can I fill it in on my phone?**

An electronic version is being introduced. Ask your insurer whether its app offers it. The paper form remains valid everywhere, including without a network.

**The other car has foreign plates. What changes?**

Fill in the same form. Claims against vehicles covered by a green card are handled in Morocco by the BCMA, in Casablanca. See [a car accident abroad](https://dashboard.cr43dv6zq7.com/morocco-insurance-guide/en/car-accident-abroad/) for the reverse case.
